2. Products

Vizuals by Nick offers photographic prints and wall art products. Product images displayed on the website are intended as accurate representations. However, actual colors, brightness, and appearance may vary depending on screen settings, printing processes, and materials. All prints are produced on demand after an order has been placed.

3. Pricing

All prices displayed on the website are shown in the applicable currency and are subject to change without notice. The price displayed at checkout is the final purchase price, excluding any applicable taxes, duties, customs fees, or import charges that may apply in the destination country. Customers are responsible for any customs duties or import taxes imposed by local authorities.

4. Orders and Payment

Orders are processed after successful payment has been received. We reserve the right to refuse or cancel orders in cases of: Suspected fraud, Pricing errors, Product availability issues, Violation of these Terms. If an order is cancelled after payment has been made and production has not yet started, a full refund will be issued.

5. Production and Shipping

All prints are produced by a professional print fulfillment partner. Production times may vary depending on product type and destination. Estimated delivery times are provided for informational purposes only and are not guaranteed. We are not responsible for delays caused by: Shipping carriers, Customs inspections, Weather conditions, International shipping disruptions, Events outside our reasonable control.

6. Returns and Refunds

Because all products are made to order and produced specifically for each customer, returns and cancellations are not accepted once production has started. If your order arrives: Damaged, Defective or Incorrect, please contact us within 14 days of delivery and provide photographs showing the issue. If the issue is confirmed, we may offer: A replacement product, A partial refund, A full refund at our discretion and in accordance with applicable consumer protection laws.

Verification of Damage Claims

To protect against fraudulent refund or replacement requests, including the submission of manipulated, altered, or artificially generated images, Vizuals by Nick reserves the right to request additional verification before approving a refund or replacement.

Such verification may include additional photographs, video evidence, or a brief live video call during which the customer can demonstrate the condition of the product. Failure to provide reasonable verification may result in the claim being denied where permitted by applicable law.

7. Right of Withdrawal

Under EU consumer protection regulations, the right of withdrawal does not generally apply to goods that are made to the consumer's specifications or clearly personalized. As all prints are produced on demand following a customer's order, orders may not be eligible for cancellation or withdrawal once production has begun. Nothing in these Terms affects any mandatory consumer rights granted under applicable law.

8. Intellectual Property

All photographs, images, designs, logos, text, and content displayed on this website are the intellectual property of Nick van Eijk and/or Social Fresh Up unless otherwise stated. Purchasing a print does not transfer copyright ownership. Customers may not: Reproduce images, Resell images, Digitally distribute images, Use images for commercial purposes without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Social Fresh Up and Nick van Eijk shall not be liable for:I ndirect losses, Consequential damages, Lost profits, Business interruption, Delays caused by third parties. Our total liability shall not exceed the amount paid for the relevant order.

10. Privacy

Personal information is processed in accordance with our Privacy Policy and Cookie Policy.

11. Governing Law

These Terms & Conditions are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts in the Netherlands.
